PUBLIC HEARING
Notice is hereby given that on December 3, 2009, a public hearing will be held in the offices of the Ohio Higher Educational Facility Commission, 30 East Broad Street, 36th Floor, Columbus, Ohio, commencing at 11:00 a.m., with respect to the proposed issuance by the Ohio Higher Educational Facility Commission (the Issuer) of State of Ohio Higher Educational Facility Revenue Bonds (Kenyon College Project) (the Bonds), in one or more series pursuant to a plan of finance, in an aggregate principal face amount not to exceed $160,000,000 to assist Kenyon College (the College) in providing funds to pay costs relating to (i) refunding all or a portion of the Issuers outstanding (a) State of Ohio Higher Educational Facility Adjustable Demand Revenue Bonds (Kenyon College 1992 Project) (the 1992 Bonds), which 1992 Bonds were issued to provide funds to pay costs relating to the construction and renovation of student residence facilities, construction of a building for use by the College art department, constructing an addition to the Wertheimer athletic field house and improving athletic facilities, and refinancing loans incurred by the College to fund the construction, renovation, equipping and improving of educational facilities including a student residence telephone system, a computer network, an addition to the bookstore and the acquisition of real property for student housing and other College purposes (collectively, the 1992 Project), (b) State of Ohio Higher Educational Facility Revenue Bonds (Kenyon College 1998 Project) (the 1998 Bonds), which 1998 Bonds were issued to pay costs relating to constructing and equipping two new science buildings and renovating Samuel Mather Hall (academic instruction building), including equipment to provide for science instruction, renovating and expanding Rosse Hall to provide for music instruction and making other improvements, and renovating certain campus buildings to replace roofs, upgrade mechanical systems, science instrumentation and other equipment and making other improvements (collectively, the 1998 Project), (c) State of Ohio Higher Educational Facility Adjustable Demand Revenue Bonds (Kenyon College 1999 Project) (the 1999 Bonds), which 1999 Bonds were issued to pay additional costs of the 1998 Project and costs of renovating and equipping two existing science buildings to provide for science and other instruction, constructing and equipping athletic and recreational facilities, office facilities for staff and faculty, an environmental study facility and a multipurpose student recreational facility, renovating certain campus buildings to replace roofs, upgrade mechanical systems and make other improvements and acquiring and installing computer systems, science instrumentation and other equipment and making other improvements (collectively, the 1999 Project) and (d) State of Ohio Higher Educational Facility Adjustable Medium Term Revenue Bonds (Kenyon College 2002 Project) (the 2002 Bonds), which 2002 Bonds were issued to pay costs relating to constructing, equipping, furnishing and otherwise improving the Kenyon Athletic Center, including a field house, arena, swimming pool, courts, training and fitness facilities, lockers, lounges, classrooms, meeting space, offices and other related facilities, constructing, equipping, furnishing and otherwise improving new space for science, environmental studies, foreign language and music instruction, and for administrative and other academic uses, and constructing, renovating and equipping other educational facilities, all together with necessary site improvements, and costs relating to renovating certain campus buildings to replace roofs, heating, ventilation and air conditioning systems, building renovations and the purchase of equipment for various buildings (collectively, the 2002 Project, and together with the 1992 Project, the 1998 Project and the 1999 Project, and as to all such facilities the acquisition, installation and improvement of all related fixtures, furnishings and equipment, building and site improvements and site acquisitions, collectively the Project) and (ii) such other uses as are permitted by State law, including costs incidental thereto and costs of financing and refinancing thereof, costs in connection with the termination of any credit or liquidity facility relating to the 1992 Bonds, the 1998 Bonds, the 1999 Bonds or the 2002 Bonds, to provide for capitalized interest, to provide for a debt service reserve fund and to pay certain issuance costs related to the Bonds. The Project is located within the Village of Gambier, Ohio on the campus of Kenyon College and on property adjacent or otherwise in close proximity thereto. The Colleges administrative offices are located at 209 Chase Avenue, Eaton Center South, Gambier, Ohio 43022. The initial owner of the Project identified at the date hereof is Kenyon College, an Ohio nonprofit corporation. The Bonds will be special obligations of the Issuer and will not constitute a debt or a pledge of the faith and credit or the taxing power of the Issuer. Persons wishing to express their view on the proposed bond issuance may appear at the hearing or may submit their views in writing regarding the proposed issuance of bonds and the location and nature of the proposed facilities to be financed. Any written submissions should be sent to the Issuer at Ohio Higher Educational Facility Commission, 30 East Broad Street, 36th Floor, Columbus, Ohio 43215, Attention: Chairman, and clearly marked Re: State of Ohio Higher Educational Facility Revenue Bonds (Kenyon College Project). Written submissions should be mailed in sufficient time to be received before the referenced public hearing on December 3, 2009.
