As a parent who has gone through a very contentious custody case and won, I can tell you that despite what Magistrate Cohen says about both parties being viewed equally, in reality the mother is still very much favored. I was a father who got full custody of two young girls, and all of the proof was on me to prove that the mother was unfit, not just who was the better parent. The mother will always win unless it can be clearly be proven she is unfit in some way, not that she is the worse parent between the two. I also came away with a very negitive view of how little work judges do and how much their laziness ends up costing both parties. I can show conclusivly that one judge cost me $10,000 twenty years ago, only because he was appointed to a higher court during the active trial and didn't want to complete the case. It then took an additional 9 months for a new judge to be reappointed to the case which also cost me additional legal fees during that period, which is not included in the $10,000 I had already lost from the case being discontinued. I've have also learned to monitor how much time a lawyer says he has used and to make sure that time is valid and not time he used as an excuse to increase his bill. In brief, dispite it being a very highly emotional period for both parties you still have people, namely lawyers, who can take advantage of the individuals, and there are judges who put very little thought into what each parent is undergoing emotionally during this period and how important his decision will be for not just the parents, but mainly for the children.
