Five sentenced in court

MOUNT VERNON — Common Pleas Judge Otho Eyster sentenced five people on Friday.

Joshua Jacobs, 23, Howard, appeared in court for the revocation of his post release control. Jacobs had been released from prison last November after serving more than a year on convictions of two counts of robbery, safecracking, two counts of breaking and entering, possessing criminal tools, theft, vandalism and criminal damaging. Jacobs violated his parole after he was found drinking in a High Street bar. Eyster ordered that Jacobs return to prison to serve the remainder of his four-year sentence. Jacobs will not be eligible for judicial release and will serve the full term.

Marinda L. Smail, 23, Mount Vernon, also appeared in court on the revocation of her post release control. Smail was sentenced last July to 11 months in prison for two counts of theft and two counts of forgery. She was released from prison after serving 100 days. According to court records, Smail violated the terms of her control by testing positive for marijuana and alcohol. Eyster reinstated her initial sentence and Smail will serve the remainder of her 11-month prison term.

Michael A. Puluso, 23, Mount Vernon, pleaded guilty to one count of gross sexual imposition, a third-degree felony. Puluso admitted in court to molesting his 8-year-old niece in her Mount Vernon residence. Eyster ordered a presentence investigation and Puluso remains incarcerated pending his posting of a $25,000 cash bond. He is scheduled for sentencing on March 29 when he faces up to five years in prison and fines up to $10,000. Puluso will also be required to register as a sexual offender.

Jesse P. Humphrey, 27, Mount Vernon, pleaded guilty in December to four counts of aggravated trafficking in drugs, all fourth-degree felonies. Eyster sentenced him to serve three years of community control, pay $1,630 in restitution to the MVPD for money acquired during drug deals, six-month driver’s license suspension, attend the Spencer House drug rehabilitation facility, and continue drug and alcohol monitoring. Eyster said that any violation of his community control could land him up to 17 months in prison. Humphrey is one of 14 people involved in alleged drug deals with MVPD Confidential Informant Jason Blubaugh.

Robert A. Schaade, 40, Mount Vernon, pleaded guilty in December to one count of aggravated trafficking in drugs. Eyster sentenced him to three years of community control, pay $600 in restitution to the MVPD, six month driver’s license suspension, drug and alcohol assessment, and a drug and alcohol monitoring. Any violation of his community control could land him up to 15 months in prison. Schaade admitted in December to selling drugs to the informant Blubaugh.
