MOUNT VERNON — Prosecutors have dismissed charges against two men accused of selling drugs to Jason Blubaugh, a confidential informant for the Mount Vernon Police Department. Knox County Prosecutor John Thatcher dismissed felony drug trafficking charges against Estaban A. Gonzalez Worley and Calib M. Lang.
According to court records, in both cases Thatcher said “the state of Ohio currently lacks sufficient evidence to prove the stated charges beyond a reasonable doubt.”
Worley, 19, was originally charged with one count of aggravated trafficking in drugs, a second-degree felony, and could have faced up to eight years in prison if convicted, according to court records. According to the indictment, Worley allegedly sold a bag of methamphetamine to Blubaugh on July 12, 2007. Multiple tests of the substance that Blubaugh told police was meth revealed no trace of a controlled substance, according to the court file.
The detective’s report shows that Blubaugh handed police a plastic bag of “thick, brown liquid” that Worley said was meth. The Bureau of Criminal Identification and Investigation could not identify the substance, and called it a clear bag of “wet crystals.”
Records show that Calib M. Lang, 24, pleaded guilty on March 31 to a reduced charge of failing to report a crime, a minor misdemeanor. Lang was originally charged with aggravated trafficking in the fourth degree.
According to police records, Lang was allegedly present during a pre-arranged drug deal between Blubaugh and Robert M. Fraley on June 12, 2007. The report states that Blubaugh allegedly paid $650 for six tablets of Oxycontin. According to the report, Blubaugh told police that Lang merely “watched the transaction take place.”
Fraley pleaded guilty on Feb. 1 to four counts of trafficking in drugs, all fourth-degree felonies, and received 60 days in jail and a three-year community control sentence.
On the reduced charge of failing to report a crime, Lang received a $150 fine, 30 days in jail suspended and two years of reporting probation.
Blubaugh was recently arrested in Fairfield County on misdemeanor charges of theft and falsification, and faces one count of possession of heroin in Delaware County. He was released to Delaware County Jail on April 18, where he is being held without bond, pending his arraignment.
Blubaugh was subpoenaed to testify against Worley and Lang in court.
Prosecutors also dismissed charges against Jay Newland on April 8 for lack of evidence in a case requiring Blubaugh’s testimony.
