Five sentenced by Eyster

November 8, 2008

MOUNT VERNON — On Friday, Judge Otho Eyster in the Knox County Court of Common Pleas sentenced four men and one woman for various felony crimes and violations of community control supervision, according to Knox County Prosecutor John Thatcher.

William L. Garlic, 31, was sentenced to a three-year prison term for aggravated arson. Thatcher said in the early morning hours of Aug. 24, 2007, Garlic set a fire with gasoline inside his Granville Road residence that resulted in the total destruction of the house. The initial investigation, conducted by Capt. Richard Brenneman, Knox County Sheriff’s Office, revealed that Garlic and his wife were experiencing marital difficulties at the time, although Mrs. Garlic was away from home on business. The arson was also investigated by the State Fire Marshal’s Office and the special investigative unit of the insurance company that insured the property.

John F. Lyon, 45, Mount Vernon, was sentenced to a three-year term of community control supervision for selling marijuana on June 27 to a confidential informant working for the Mount Vernon Police Department. Lyon was also convicted of possession of marijuana. Lyon’s community control sentence includes a 30-day jail sentence and a six-month driver’s license suspension that starts immediately, and Lyon forfeited $745 and a 1995 Jeep Cherokee to the MVPD as drug offense proceeds and contraband related to the trafficking conviction.

Thatcher said Lyon will serve an 11-month prison sentence if he violates any term of his supervision. Detective Sgt. Jeff Jacobs, Detective Cpl. Matt Dailey and Detective Craig Feeney, MVPD, investigated the case.

Matthew W. Brady, 23, Mount Vernon, was sentenced to serve an 11-month prison term for possessing two stolen credit cards on Feb. 3, and for using the credit cards to run up unauthorized charges totaling $637.17, between Feb. 3 and March 2. Brady’s sentence will be served concurrently with an 11-month prison sentence from a prior stolen credit card conviction.

Brady’s community control supervision was revoked Friday due to his failure to notify his probation officer that he was cited by the Ohio State Highway Patrol for a driver’s license offense on Sept. 19. Patrolman Jessica Butler, MVPD, and Detective Roger Brown, KCSO, investigated the cases.

Curtis L. Wade, 19, Howard, had served all but 47 days of his prison sentence for burglary and petty theft when he was terminated unsuccessfully from the program at the Licking/Muskingum Community Correctional Center. The 47 days remaining were imposed today as a jail sentence that starts immediately. Patrolman David McElroy, MVPD, investigated the burglary case.

Rebecca L. Wolfe, 45, Mount Vernon, was convicted of reckless homicide and driving under the influence of alcohol. Wolfe was sentenced to a three-year prison term and her driver’s license was suspended for three years. Thatcher said that in the early morning hours of April 15, Wolfe crashed the 1998 Isuzu Rodeo she was driving into a tree near U.S. 36 in Mount Liberty. Wolfe’s passenger, Rickey E. England, was killed in the crash. Wolfe had a blood alcohol level of 0.265 at the time. Trooper Megan Ferguson, OSHP, investigated the case.
