MOUNT VERNON — Indictments were returned in 13 cases on Monday by a Knox County grand jury. Arraignments are scheduled for Friday, Dec. 12, at 9 a.m., in the Knox County Court of Common Pleas before Judge Otho Eyster.
According to Knox County Prosecutor John Thatcher, Ashley N. Beardsley, 19, is charged with escape for allegedly escaping from the back seat of a police cruiser on Nov. 1 at about 4 a.m. Thatcher said that at the time, Beardsley was under arrest for underage consumption of alcohol and a probation violation. Patrolman Jeremiah Armstrong, Mount Vernon Police Department, found Beardsley hiding in a nearby apartment a short time later.
Chad A. Cheever, 35, Danville, was indicted for robbing a man in his Mount Vernon motel room on Sept. 20 at about 10 p.m. Thatcher said that Patrolman David McElroy, MVPD, took the alleged victim’s report that Cheever came into his room, assaulted him, then stole his cell phone and other personal items.
Debbie S. Fabian, 44, Heath, is accused of passing eight checks written on a closed account to a local credit union between April 6 and 12. Thatcher said the eight checks totaled $1,652. Deputy Tim Light, Knox County Sheriff’s Office, investigated the case.
Jack O. Haggerty, 28, is accused of engaging in sexual conduct with a 15-year-old girl at his Hyatt Road, Mount Vernon, residence, on Oct. 17. Thatcher said Haggerty is charged with unlawful sexual conduct with a minor, and the degree of the felony is enhanced due to the fact that Haggerty was more than 10 years older than the victim at the time of the alleged offense. Alan C. Jenkins, 42, Mount Vernon, was indicted for burglarizing a residence on Sycamore Road, Mount Vernon, and for breaking into a storage building at the next-door residence, on July 22. Thatcher said Jenkins allegedly stole a video game system, video games and collectible figurines from the residence, and a hedge trimmer from the storage building. Paul G. Lampl, 55, Mount Vernon, is accused of unlicensed manufacturing of fireworks. According to Thatcher, on May 10, Lampl possessed a license to exhibit fireworks but not a license to manufacture fireworks. On that day Lampl caused an accidental fire and explosion at his Grange Avenue residence. In the course of the fire investigation, it was determined that Lampl allegedly had components to manufacture fireworks in his basement. Investigator Tom Benson, State Fire Marshall’s Office, and investigator Jason Whaley, Mount Vernon Fire Department, investigated the case.
Wayne E. Mast, 24, Ashland, faces charges of rape, gross sexual imposition and kidnapping. Thatcher said that during a party in the early morning hours of Oct. 12, Mast allegedly pushed an 18-year-old female into the bathroom of a house on Rabbit Ridge Road, where he engaged in sexual conduct with her by force. Several other people at the party confronted Mast in the bathroom when they heard the alleged victim scream. Detective David Light, KCSO, investigated the case.
Patrolman Matt Jones, MVPD, allegedly found a baggie containing cocaine in Michael L. Poe’s pants pocket during a search incident to an arrest for a probation violation, on Nov. 3 at about 4:30 a.m. Poe, 19, Mount Vernon, was indicted for possession of cocaine.
Amanda J. Price, 19, Carlisle, Pa., is accused of shoplifting 12 DVDs from a Mount Vernon store on Oct. 2 at about 6 p.m. Thatcher said a store security officer allegedly saw Price put one of the DVDs in her purse. Price dropped the purse in the store parking lot when she ran from the store security officer. The value of the DVDs allegedly exceeds $500. Patrolman Brian Weiser, MVPD, caught Price in the driveway to the store.
Brian L. Scurlock, 23, Centerburg, was indicted for allegedly breaking into a Centerburg pizza shop on Feb. 1 at about midnight. Thatcher said the Bureau of Criminal Identification and Investigation compared blood evidence collected from a broken window at the pizza shop with other evidence collected from Scurlock, allegedly resulting in a positive DNA match. Detective Sgt. Gary Rohler, KCSO, investigated the case.
According to the indictment, Derek A. Showalter, 28, Mount Vernon, was convicted of aggravated assault in 2004. Thatcher said Showalter is legally prohibited from possessing a firearm because of his conviction for a felony offense of violence. Showalter is charged with having a weapon while under disability for allegedly possessing a 20 gauge shotgun on Sept. 3. Patrolman David McElroy, MVPD, investigated the case.
According to the indictment, Rusty V. Stiltner, 28, was convicted of domestic violence in 2001, and felony domestic violence in March 2008. At about 5 a.m. on Oct. 3, Stiltner allegedly assaulted his 45-year-old mother at her residence. Deputy Ryan Burgess, KCSO, took the report on the case.
Frank A. Setser, 25, Mount Vernon, faces charges of felonious assault and child endangering for allegedly shaking a 7-week-old infant on May 31. On June 2, the child was treated at Nationwide Children’s Hospital, where it was determined the child had allegedly sustained abusive head trauma with shaking and impact mechanisms identified, sometimes called “shaken baby” syndrome. Setser allegedly confessed to Detective Sgt. Jeff Jacobs, MVPD, that he shook the baby, according to Thatcher.
