MOUNT VERNON — Although the testimony phase in the John Freshwater contract termination hearing has ended, legal maneuvering continues in two related civil suits: Doe versus John Freshwater and Freshwater versus Mount Vernon Board of Education et al.
Thursday’s edition of the News pointed out some of the recent action in the Doe versus Freshwater suit.
Regarding Freshwater versus MVBOE, United States District Judge Gregory Frost has set the following deadlines and hearing dates:
•The parties will complete all non-expert discovery on or before Oct. 31.
•The parties shall file all dispositive motions on or before Nov. 30. Opposition memoranda shall be filed within 21 days, and a reply memorandum shall be done within 11 days.
Janet Hulse, chief deputy clerk with Mount Vernon Municipal Court, said dispositive motions can be anything that would close or settle the suit before it goes to trial. They can include things such as motions on pleadings, judgments on pleadings and motions for summary judgment.
•A non-oral hearing on all dispositive motions is scheduled for Jan. 28, 2011.
•A final pre-trial conference is scheduled for April 28, 2011.
•The jury trial is scheduled to commence on June 20, 2011.
