COLUMBUS — No decision was rendered Thursday at the evidentiary hearing related to the Doe family lawsuit against John Freshwater.
On June 1, U.S. District Judge Gregory Frost ordered Freshwater and his attorney, Kelly Hamilton, to turn over certain documents, billing records and materials related to the Does’ case. Sanctions were subsequently imposed by the judge against Freshwater and his attorney because Freshwater and Hamilton did not produce certain documents and materials requested.
Hamilton then filed a motion asking the court to reconsider its order to produce the material and to pay attorney fees and costs for the Doe family related to attempts to obtain the material.
On July 2, the attorney for the Doe family, Doug Mansfield, filed a counter motion to Kelly Hamilton’s request that the judge reconsider the sanctions against himself and Freshwater.
Freshwater and Hamilton replied then to Mansfield’s counter and requested an oral hearing on the matter.
Mansfield said Freshwater testified in the hearing on Thursday, as did Mount Vernon City Superintendent of Schools Steve Short and the school board’s attorney David Millstone.
Mansfield said the judge indicated he will “rule on the matter in short order.”
