MOUNT VERNON — The Mount Vernon Board of Education has responded to the appeal filed by John Freshwater, the middle school teacher fired by the board for injecting his personal religious beliefs into his instruction of students and for insubordination.

Attorney Sarah Moore, of the law firm Britton, Smith, Peters & Kalail, said the board filed papers asking to move the Freshwater case to federal court.

“The removal was just the next step in the process,” she told the News. “Since this is pending litigation, we will have no further comment.”

Additional information about the filing is expected to be available from the court this afternoon.
