MOUNT VERNON — On Friday, Knox County Common Pleas Court Judge Otho Eyster handed down sentences in six felony cases, according to Prosecutor John Thatcher.
Joshua J. Peschke, 38, Mount Vernon, was convicted of aggravated possession of drugs and aggravated trafficking in drugs. Peschke was sentenced to a mandatory term of four years in prison, mandatory drug fines totaling $12,500 were imposed and his driver’s license was suspended for five years. Thatcher said Peschke was arrested on March 16, after he sold 100 Percocet tablets to a confidential informant working for the Mount Vernon Police Department. Peschke had another 178 Percocet tablets and $4,768 in cash when he was arrested. The cash was forfeited to the state of Ohio because it was involved in Peschke’s illegal drug activity. Levi C. O’Rourke, 21, Mount Vernon, was convicted of burglary and receiving stolen property for breaking into an apartment on Wooster Road and possessing a stolen laptop computer on March 7. O’Rourke was sentenced to 17 months in prison and ordered to pay $636 in restitution to the crime victim. Patrolman Justin Trowbridge, MVPD, investigated the case.
Cyle E. Cunningham, 21, Danville, was convicted of attempted domestic violence attempting to assault his wife on Feb. 7. Cunningham was sentenced to a three-year term of community control supervision, including a 30-day jail sentence. An 11-month prison sentence will be imposed if Cunningham violates the terms of his supervision. Thatcher said the offense is a felony because Cunningham was convicted of domestic violence on Jan. 24 in the Mount Vernon Municipal Court. Sgt. Dan Weckesser, Danville Police Department, handled the domestic disturbance call.
James D. Yors, 43, and Tammy J. Carman, 48, both of Mount Vernon, were convicted of grand theft for stealing in excess of $5,000 worth of Xbox and PS3 video games between Dec. 6, 2010, and Jan. 15, 2011. Yors was sentenced to 17 months in prison. Carman was sentenced to a three-year term of community control supervision, including drug and alcohol use monitoring. Carman will serve a 17-month prison term if she violates the terms of her supervision. Yors and Carman were also ordered to pay restitution to the crime victim. Thatcher said the video games were stolen from a Mount Vernon department store and then sold at a video games buyback store, near Newark. Detective Craig Feeney, MVPD, investigated the case.
On Oct. 30, 2009, Miranda L. Wintz, 29, Mount Vernon, was convicted of theft and receiving stolen property. An 11-month prison sentence was suspended while Wintz served a three-year term of community control supervision. Wintz admitted she violated the terms of her supervision when she was arrested for shoplifting on Aug. 6, 2011. Wintz was sentenced to 11 months in prison.
