MOUNT VERNON — According to Knox County Prosecutor John Thatcher, the Fifth District Court of Appeals recently affirmed Erica D. Colopy’s conviction for child endangering, a felony of the third degree, in connection with the death of a 3-year-old Mount Vernon boy, on Oct. 8, 2009.
Thatcher said the boy died as the result of a serious brain injury sustained in a fall down a flight of stairs in his home, on Oct. 6, 2009. He said at that time, Colopy was living with the boy’s father, and she was in charge of caring for the boy while his father was at work. In December 2010, Common Pleas Court Judge Otho Eyster convicted Colopy after a bench trial. A pre-sentence investigation was conducted before Eyster sentenced Colopy to four years in prison, on Jan. 28. Thatcher explained that Colopy’s prison sentence was stayed while she appealed her conviction. Colopy started serving her four year sentence Friday because her appeal was unsuccessful, Thatcher said.
