MOUNT VERNON — Michael R. Lyon, 47, of Butler, was scheduled for arraignment on Tuesday in Mount Vernon Municipal Court, but Monday his attorney filed a not guilty plea on his behalf. The case will be scheduled for a pretrial hearing.
Lyon was charged on Dec. 31 with taking an animal out of season and with eight counts of taking a second deer without permission. The Ohio Division of Wildlife filed a report that noted Lyon was arrested on Nov. 13 at 11:50 p.m.
According to the report, Lyon was observed by aircraft, driving on College Hill and Hostetler roads, near Nunda, and shining lights out both sides of his vehicle. When officers on the ground contacted Lyon and other men, they found a loaded .22 caliber rifle in the vehicle and a 30.06 rifle in the weeds near the vehicle.
Ohio’s week-long deer gun season did not open until Monday, Nov. 26.
